- Allahabad High Court's Lucknow Bench directs CBI probe after overturning lower court’s rejection of plea seeking FIR against Congress leader

The Lucknow Bench of the Allahabad High Court has ordered the registration of an FIR against Congress leader Rahul Gandhi, escalating his legal troubles. The directive came during a hearing on Friday in connection with allegations related to dual citizenship.
The case pertains to a challenge against a lower court order that had earlier dismissed a plea seeking the registration of an FIR against Gandhi. Representing the Uttar Pradesh government, counsel argued that the matter should be investigated by the Central Bureau of Investigation (CBI). The bench accepted the request, directing that an FIR be registered and the probe be handed over to the CBI.
Following the court’s order, the investigation will now be conducted by the central agency.
The petition was filed by Karnataka-based BJP worker S. Vignesh Shishir,, who challenged a January 28, 2026 order of a special MP/MLA court in Lucknow. That court had rejected his plea seeking directions for an FIR against Gandhi.
In his petition, Shishir alleged serious violations under multiple laws, including provisions of the Bharatiya Nyaya Sanhita (BNS) 2023, the Official Secrets Act, the Passport Act, and the Foreigners Act. He argued that the issue was not just about citizenship but also involved national security concerns, and called for a detailed investigation and strict action.
The petition specifically sought the registration of an FIR under serious sections, citing alleged violations linked to dual citizenship.
