The District Consumer Disputes Redressal Commission has ruled against a Red Tape showroom on Shimla’s Mall Road for charging customers extra for branded carry bags after the purchase of products. The commission termed the practice a deficiency in service and an unfair trade practice, directing the company to refund the ₹10 bag charge and pay a total compensation of ₹24,000 in three separate consumer complaints.
The complaints were filed by Subhash Chandra of Mandi and Shimla residents Anil Thakur and Gaurav Kumar. According to the complainants, they purchased Red Tape products, including trunks, shirts and jeans, from the Mall Road outlet in 2025. At the billing counter, employees provided carry bags, which customers believed were complimentary. However, they later discovered that ₹10 had been added to their bills for the bags.
When the consumers objected and sought a refund, store staff allegedly refused, citing the billing entry. During the hearing, the showroom argued that the charge was levied to promote environmental protection and reduce the use of paper and plastic bags, adding that customers were not compelled to purchase them.
However, the commission bench comprising President Dr. Baldev Singh and Member Nidhi Sharma rejected the argument, citing National Consumer Commission guidelines. The commission observed that the carry bags carried the company’s name and “Go Green” logo, effectively making them promotional material. Under consumer protection norms, businesses cannot charge customers for bags displaying their brand name, logo or advertisements.
Referring to the Sale of Goods Act, the commission stated that it is the seller’s responsibility to deliver purchased goods to customers in a proper manner. The Red Tape outlet has been directed to comply with the order within 45 days.
