Trump administration has completed its review of a proposal that would eliminate the discretionary 60-day grace period currently available to H-1B and other foreign workers after losing their jobs. The move could affect thousands of Indian professionals and their families living in the United States.
According to U.S. regulatory records, the proposal was submitted to the White House Office of Information and Regulatory Affairs on August 6 and its review was completed on August 27. The proposal has advanced with modifications, but it has not yet been officially published, meaning the existing 60-day grace period remains in effect for now.
Under current rules, eligible visa holders can stay in the U.S. for up to 60 days after job loss to find a new employer, change their immigration status, or prepare to leave the country. The provision applies to H-1B, L-1, O-1 and several other temporary work visa categories.
Indian nationals make up the largest share of H-1B visa beneficiaries, raising concerns that any change to the rule could create significant uncertainty for Indian professionals. Critics of the proposal have argued that the grace period should be extended rather than eliminated.
